Announcement by the Speaker

Announced two disqualification petitions filed by Shri Chandrakant Kavlekar, MLA against Smt. Victoria Fernandes and Shri Agnelo Fernandes, MLA against S/Shri Ramkrishna and Pandurang Dhavalikar under paragraph

2(a) and 2(b) of the Tenth Schedule of the Constitution of India and  Hon‟ble Speaker  ordered  ad-interim  ex-parte  relief  in terms of the prayer and Respondents are restrained from functioning as Members  of the Legislative Assembly and/or from participating in the proceedings in the House and/or from voting in the House and Hon‟ble Speaker directed Secretary Legislature to issue appropriate Notices to the Respondents and such Notices will be made returnable on 13.8.2007 at 11:00 a.m.

Announcement by the Speaker

Made an observation that the daily adjournment of the House late in the night has caused severe inconvenience to Members. He read out a statement of timings  of  commencement  of  sittings  in  other  State Legislatures   and   sought   the   sense   of   the   House   for commencing the sitting of the House at 11:00 am everyday. The  Leader  of  Opposition  desired  that  the  House  may commence its sitting at 12:00 noon. Shri Mauvin Godinho, Deputy Speaker desired that the timings may be changed from the next Session. The House, however, did not arrive at any decision.

Ruling of the Speaker On Breach of Privilege

Hon‟ble Members,Shri Ravi Naik, the Home Minister has raised a question of breach of privilege against some members of the Bihar State Subordinate Judiciary. He has quoted some news reports to substantiate his case of breach of privilege.

 As of now, I have only news reports as mentioned by the Home Minister. I, therefore, direct the Advocate General of the State to collect all necessary information pertaining to this case and bring them before me as early as possible.

However, the general position about privileges of Members is that no Court can call to account either the House or its Committees. This is the Constitutional guarantee provided in articles 194 read with 212 to ensure the independence of Legislature vis-à-vis an over-arching judiciary.In order to ensure free speech in the House as guaranteed under article 194 of the Constitution of India, I rule that Shri Ravi Naik shall not be bound to accept any notice from any court or file any affidavit or any other such paper or even enter into appearance before any court for whatever he has said in the House, in case the news reports are true.As  and  when   time   comes,   it will  be  the  responsibility of  the Advocate   General    of    the    State,   by    himself   or    through appropriate  counsels, to  apprise  the  Court   concerned  of  the correct Constitutional I position

I disallow the notice of adjournment motion given by the Leader of Opposition and others on a news report that appeared in Tarun Bharat dated24.3.2009 that one Shri Kavesh Gosavi, on bail in a criminal case, was forced by the police to implicate the Leader of Opposition and the Hon‟ble MP from the North Goa in the temples and idols desecration cases.

“ I wish to draw your attention to a letter to the editor in the daily „Gomantak Times‟ dated 22/7/2010 under caption “Let CBI probe drug scam in the State” written by Shri J.M. de Almeida (Porvorim). The said letter  has  cast  serious  reflections  on  the  decision  of  the Speaker in the House. 

The extracts of the letter in question reads as follows:- 

The opposition protested and the Speaker adjourned the House twice, thereby showing favouritism to the treasury benches. This attitude of the Speaker does not augur well for democracy, in as much the Speaker is expected not only be independent, impartial but above all not to side with the party to which he belonged prior to his assuming the high office of Speaker of the Goa Assembly’.

 The rules of the House provide the powers and functions of the Speaker. All the powers vested with the Speaker are intended to enable him to ensure the smooth functioning of the House. I being the custodian of the House with dignity and decorum. As there was an unruly situation in the House, I in my wisdom adjourned the House.

The letter to the editor in the Gomantak Times has cast reflections on the conduct of the Speaker and the neutrality of the Chair, undermining the prestige of the Speaker and the House which prima facie amounts to a breach of privilege by the  writer  of  the  article,  editor  and  publisher  of  the  daily

„Gomantak Times‟. 

In order to uphold the dignity of the Chair and restrain such incidents in the future, I refer the matter to the Committee of Privileges for examination and report.“ I wish to draw your attention

 This House strongly recommends the Government to have police cars stationed at important points on the highway with loudspeakers, in order to instruct the heavy traffic drivers not following the Highway Code and to allow the slow traffic to move towards the left of the road to ensure safe and smooth flow of vehicles, and thus avoiding accidents.

CONDOLATORY MOTION

This House condoles the sad and untimely death of Shri Sarabjit Singh,  prominent citizen of India, this morning in the Lahore Hospital in Pakistan after a murderous attack on him in Kot Lakhpat jail last week where he spent 22 years after being convicted for terrorism. This House condemns the killing of our citizen while in custody of the Pakistan jail authorities and demands that the Pakistan Government conduct a thorough investigation to identify those responsible for this heinous act and be punished accordingly. This House shares in the irreparable grief of his family.

CONDOLATORY MOTION

Hon’ble Speaker requested the Members to move all the condolatory
motions together.   

(1)  “This House condoles the death of Shri Chandrashekhar, the former
Prime Minister of India, a socialist who proved that political ambition and
idealism can cohabit.”

(2) “This House condoles the death of Shri Dilip Sardessai, the son of
Goan soil who played for the Indian Cricket test team and brought name
and fame to every Goan in the cricketing arena.”

(3) “This House condoles the death of Shri Dattaram Wadkar, the noted
Bollywood music composer of yesteryears, one can see his name in the
credit of most landmarked Hindi films, a magnanimous son of Goa whose
contribution to the film industry in India is incomparable.”

(4) “This House condoles the death of “Goem Shahir” Shri Ulhas Buyao
who  passed away on 16th April, 2007, in his death, Goa has lost a well
known multifaceted personality, who has given valuable contribution to the
Goan culture as a singer, lyricist, music composer, script writer and stage
artist. He was also known for his role during the historic opinion poll, in
1967. This House conveys its deep sympathies to his family members.”
 
(5) “This House condoles the death of Shri Sahib Singh Verma, senior
BJP Leader and former Delhi Chief Minister, who died in a road accident
at Alwara in Rajasthan on 30th June 2007. In his untimely death, India has
lost a leader who worked tirelessly for the downtrodden, initiated reforms
in the labour sector as Union Labour Minister. He was known for his
simplicity. This House conveys its deep sympathies to his family
members.”

SHRI PRATAPSINGH R. RANE, Speaker  moved the following:

 “This House wholeheartedly congratulates Smt. Pratibha Patil the
President – elect as the Country’s First Woman President, to be the
Thirteenth President, elected with a big margin of over three lakh vote
value, who had a glorious record of holding various Ministerial posts in the
